MINUTES OF MEETING
OCTOBER 2, 2003

PRESENT: Chairman Tracy Scott, Stan Brehm, Joanna McIntosh, Skip Lawrence, Peter Wade, Mike Stamowlaros, Ron Lesieur, Dave Colbert and Secretary Andrea Deachman

Chairman Scott introduced the Board.


DISCUSSION:                     Shaw/Luba Property
                                        Map 5, Lot 8-3
                                        Main Street & Granny How Road

The Board discussed the wet land issue that was brought to their attention by the Conservation Commission.

Mark Stevens, Registered Land Surveyor, presented DES wetlands and non-site specific permit 2003-01639 to the Board.  Mr. Stevens stated he based everything on Merrimack County Soil types plan of 1965 which is the sole soil types used by the town. He feels he presented to the Board as requested and in compliance with the zoning and subdivision regulations at that time.

Mr. Luba stated that he has attained all the permits he needs and there are no issues with the property as is.

The Board was in agreement that the subdivision was conforming and everything was in compliance at the time of the subdivision and no further findings or changes will be requested.

Chairman Scott thanked the parties for their time.

Chairman Scott requested that the Board review the minutes of September 4, 2003. Jeanne Viall requested that her name be spelled correctly.

Motion was made to accept the minutes with the spelling correction on page 3.

Abutters present: Bruce Luksza

Mr. Vermette presented the Board with a drawing of the property and where his workshop is and his Home Occupation Permit.

The Board was in receipt of the Notice of Decision by the Chichester Board of Adjustment granting and Equitable Waiver for Dimensional Requirement dated October 2, 2003.

Design Review was closed.

Being no further discussion for the Home Occupation a motion was made to approve the Home Occupation. Chairman Scott signed the Home Occupation permit.

PUBLIC HEARING:                         IMPACT FEE WAIVER WORDING

TITLE NOW READS: WAIVERS

SUGGESTED TITLE TO READ: ELDERLY WAIVER OF IMPACT FEES

THE WAIVER NOW READS: The Selectmen may grant a waiver of impact fees to Town inhabitants who have resided it the Town for ten (10) years of more and are requesting a building permit for a primary residence. Waivers may also be granted for residences to be owned and occupied by one of more Town inhabitants’ aged 62 or older.

SUGGESTED TO READ: THE BOARD OF SELECTMEN WILL GRANT A WAIVER IF ALL OF THE FOLLOWING APPLY:

YOU HAVE LIVED IN THE TOWN OF CHICHESTER, NH FOR THE LAST TEN (10) CONSECUTIVE YEARS.
YOU ARE 62 YEARS OLD OR OLDER.
YOU ARE BUILDING A PRIMARY RESIDENCE FOR YOURSELF.

After brief discussion motion was made to accept the new language and have the item placed on the ballot in March 2004 for town vote.

                                                Map 1, Lot 4, Lovers Lane

Abutters present: Todd Hammond and Lucinda Reid

Mr. Drew presented the Board with plans for this project. This is on a class 6 road and there must be a note on the plan stating this is not a buildable lot until Lovers Lane is brought up to a class 5 road and accepted by the town.

100-foot wetlands setback must be maintained. Abutters reviewed the plans

Mr. Drew presented the Board with final plans for the project. Mr. Drew will need to add a note to the plan that this is not a buildable lot until Lovers Lane is brought up to a class 5 road and accepted by the town. 100-foot wetlands setback must be maintained.

Motion was made to accept the subdivision with the note added.

                                                Site Review – Office & Auto Sales
Abutters present: None                  Map 4, Lot 155B, Dover & Cross Roads

Ms. Viall presented plans for this Site Review; they will pave the front of the building for parking and the front of the lot west of the driveway for display. There will be no servicing of vehicles on the property they will be sent out for repair. The Board requested the plan have Mark Cronis’ name on the plan as the owner and the Surveyor stamp.

The plan needs Mark Cronis’ name on the plan as the owner and the Surveyor Stamp.

Being no further discussion on the site review motion was made to accept.

Mr. Drew would like to have storage units for sale on this property, he would like to put up a sign and have the units on site.  The Board requested he do a site plan and he can have his Design Review and Public hearing on November 6, 2003.

This is a multi use complex and this practice falls within the specific uses in the CI/MF zone, therefore no site review is necessary.

Mr. Talbot presented the Board with his driveway permit and septic design plans with the building and parking drawn on. The Board was in agreement that a new site plan needs to be done for recording purposes. Design Review/Public Hearing will be scheduled for November 6, 2003.

DISCUSSION:                             Bruce Luksza
                                                Site Review – 6 Apartments
                                                Map 9, Lot 19, Swiggey Brook Road

Mr. Luksza presented plans to the Board; the plans are not exactly what Mr. Luksza would like to propose but are close. The Board requested Mr. Luksza deliver a new plan to the secretary for submission to the Town Engineer and Town Attorney for review. Mr. Luksza stated that he will own all the apartments.
There is a concern where the driveway is located. The buffer zone was also a concern.
The new wetlands zoning will hold for this property. Mr. Luksza reassured the Board that he would not cut the trees at the property line of any of his abutters. Penachuck will take over the water system. The growth ordinance is also in affect for this property, only 3 units will be allowed to be built in a year.  Mr. Luksza stated that after the project is complete he would more than likely sell the entire project. It was made clear to Mr. Luksza it cannot be changed after it has been approved, and he understands this.

Mr. Luksza will deliver a new plan early next week. Escrow account of $250. Has been requested. He would like to continue with his proposal next month.

Design Review will be set for November 6, 2003 as long as Mr. Luksza gets the plans to the Board in a timely fashion.

                                        Map 5, Lots 103 & 82, Main Street

Mark Sargent presented the Board with a plan for this project. Mrs. Frangione is giving part of her property to the school for out door classrooms, sports fields and paths. The property is behind the existing building about 41 acres will be annexed on to the school property.

Design review/Public Hearing will be scheduled for November 6, 2003.

Being no further business. Motion was made to adjourn.
